advantage of a f
ixed fee is that you know ahead of time how
much
I'm going to charge you to take your case to trial,
apply for diversion or enter a plea
.  I do not charge you the
same fee for applying for diversion as I do for taking your
case to trial.  


I charge you a higher fee to take your case to trial.  Be wary
of attorneys who offer to represent you for the same fee
regardless of whether you have a trial or enter a diversion
agreement/plead guilty.  Attorneys are paid for their time and
a properly conducted trial takes lots of attorney preparation
time.  If the attorney "earns" the same fee whether or not you
have a trial it seems logically unlikely that attorney is going
to be very eager to take your case to trial regardless of the
facts of the case.
